CHP: Applies to Constitutional Court for Annulment of Certain Laws

The CHP applied to the Constitutional Court (AYM), requesting the annulment and suspension of certain provisions of Law No. 7579 on Amendments to the Land Registry Law, Certain Laws, and Decree-Law No. 375, and Law No. 7582 on Amendments to Certain Laws.

CHP Group Deputy Chairman Gökhan Günaydın made a statement after the application to the AYM with party lawmakers.

Günaydın stated that the requests for annulment were related to asset amnesty and land registry regulations. Günaydın said, "If you have money, cash, foreign currency, gold, and related capital instruments abroad, and you bring them to Turkey, you are exempt from tax for 20 years. If these are transferred to a relative as inheritance, the inheritance tax is applied at 1 percent."

Günaydın noted that another regulation they sought to annul introduced special tax privileges for employees in qualified service and industrial zones. He stated that this regulation could lead to arbitrariness by providing corporate tax and income tax privileges to certain companies.

Günaydın stated that the regulations in the land registry law concerned citizens' right to property and housing, adding that some articles stipulated the completion of construction for title deed transfers in housing cooperatives. He also mentioned issues such as the determination of environmental consulting firms' authorities by the administration and the urgent expropriation of private properties. Günaydın argued that these regulations violated the right to property and housing.

Günaydın also reported that there were regulations such as the privatization of immovable properties held by the public, their transfer to third parties, and the recording of the obtained amounts as an allocation to the Presidency, stating that they demanded "the annulment of these regulations, which are against the public interest."

Günaydın stated that the geometric objection system in cadastral procedures was abolished by the laws. He also argued that subjecting local administrations and their companies to the President's permission to establish new companies was unconstitutional.

Among the legal regulations is also the alteration of Akşehir Lake's shoreline. The Urban Transformation Presidency's opening of pastures for construction and its exemption from the Public Procurement Law in the sale of independent sections it holds were also criticized. Günaydın stated that these articles were not in the interest of citizens and the public.

Gökhan Günaydın announced that they expect the AYM to examine both applications and decide on their annulment and the suspension of their enforcement.
